These terms and conditions govern the contract of sale between the purchaser of the online store www.epmedica.it (hereinafter referred to as the "Purchaser" for clarity) and E.P. medica Srl, Via Santa Barbara 200, int. 15, 48034, Fusignano, Ravenna, Italy, VAT number 02506400395 and Tax Code 02506400395, REA RA – 208126 Ravenna (hereinafter referred to as the "Seller").
Terms and conditions of sale
1. Content of the general terms and conditions of sale
The following general terms and conditions of sale govern all sales contracts concluded between the Buyer and the Seller through the website www.epmedica.it. Each contract is subject to the general terms and conditions of sale published on the website at the time the contract is concluded (see Article 3). Any changes proposed by the Buyer shall not alter the general terms and conditions of sale unless expressly accepted in writing by the Seller.
2. Finalization of the contract
All information about the products on www.epmedica.it, such as technical specifications, images, dimensions, or compatibility details, is not binding and is subject to change at any time, unless expressly identified as binding. If the Purchaser is misled by the aforementioned information when making the purchase, they may exercise their right of withdrawal as described in the section entitled Right of Return and Withdrawal (point 12).
3. Purchase of products
The Products displayed in the Catalog may be purchased by the Buyer selecting them and then adding them to the shopping cart. Once the selection of Products has been completed and the Buyer wishes to proceed with the purchase of those added to the cart, the Buyer will be asked to provide the information requested on the Website in order to finalize the Contract. In particular, the Buyer will be asked to provide their personal details, email address, home address, delivery address (if different from the home address), and a telephone number where they can be contacted to inform them of the delivery date of the Products in a specific section of the Website. If the Buyer chooses to pay by credit card, they will be directed to the website of the bank that owns and manages the online payment service, where they will be required to provide their credit card details via a secure connection to which the Seller does not have access.
4. Delivery of goods
Product availability is indicated in the online catalog at www.epmedica.it. The delivery times indicated are not binding, unless otherwise specified in a separate agreement. However, the Seller will do everything in its power to meet these deadlines.
5. Prices, availability, and shipping costs
The price of the Products is that shown in the Price List published on the website on the day the order is placed and before the Order is issued. The prices shown are for deliveries to addresses in Italy and include VAT.
Despite our best efforts, we cannot rule out the possibility that a small number of products in our catalog may be listed at a price that is different from the actual price. In any case, we will check the accuracy of product prices during the order verification process and subsequent shipment of the products. If, due to errors or other inconveniences, the price indicated on the website is lower than the correct sale price of a product, we will contact you to verify whether you still wish to purchase the product at the correct price. Otherwise, your order cannot be accepted. If the correct price of a product is lower than that indicated on the website, we will only charge you the correct lower price and will still ship the product to you.
Shipping costs in Italy are €8.00 (€9.00 for Sicily and Sardinia) for orders under €50.00, while shipping is FREE for orders of €50.00 or more.
Shipments to foreign countries
In the event of a request for shipment to a foreign country, both within and outside the European Union and/or the Schengen area, the rates of the carrier used by the Seller will apply.
6. Payments
Orders placed on www.epmedica.it can be paid for using the PayPal digital payment service, credit card, or bank transfer. The Seller may allow additional payment methods in the payments section on www.epmedica.it. Credit card details are sent to BPER Banca di Faenza, Via Guglielmo Oberdan, 6, 48018 Faenza RA (http://www.bper.it/), which handles credit card payments on behalf of the Seller. Credit card details sent to BPER Banca during the ordering process are protected against unauthorized access by means of 128-bit SSL (Secure Socket Layer) encrypted data transfer. All current browsers support SSL encryption. These details are not accessible to third parties, including the Seller.
7. Warranty
The Buyer enjoys the inalienable consumer rights deriving from the provisions of Articles 128 to 135 of the Consumer Code and Part IV, Title III, Chapter I, Articles 128 to 135. These rights are valid for two years from the date of delivery of the goods; any action to enforce defects not maliciously concealed by the Seller shall in any case be time-barred within a maximum period of 26 months (24 months plus 2 from discovery) from delivery of the goods. The legal warranty may be supplemented by an additional warranty offered by the Seller or the Seller's so-called conventional warranty. This additional warranty has the following characteristics: it is cumulative, optional, free of charge, and unrestricted in terms of duration, scope, and territorial coverage.
8. Copyright
All content on www.epmedica.it is protected by copyright. All proprietary rights belong to E.P Medica Srl. This website may not be: reproduced in whole or in part, transferred by electronic or conventional means, modified, linked, or used for public or commercial purposes without the prior written consent of E.P. Medica Srl.
9. Applicable law and place of jurisdiction
9.1 The applicable legislation is that of Italy.
9.2 The place of jurisdiction for any disputes is Ravenna, Italy, unless other regulations in favor of the Purchaser are applicable.
10. Final provisions
If any of these general terms and conditions prove to be invalid or become invalid at a later date, this shall not affect the validity of the remainder of this contract. In this case, the invalid term shall be replaced by a term that most closely reflects its economic intent and purpose or by the appropriate legal provisions. The Seller reserves the right to amend these general terms and conditions at any time. The amended general terms and conditions are made available on the website www.epmedica.it.
11. Security
User data is protected to the extent permitted against loss, falsification, manipulation, and misuse by third parties. In addition, the Seller uses the services of Verisign. Verisign guarantees: maximum levels of reliability and security to assure customers that the site is protected - that information sent via web browsers or other devices remains confidential. Returns
12. Returns and right of withdrawal
In the case of a Contract for the purchase of Products and Services concluded by a Purchaser, the latter shall have the right to withdraw from the Contract, pursuant to and for the purposes of Article 52 et seq. of the Consumer Code, without any penalty and without specifying the reason.
The decision to exercise the right of withdrawal must be communicated by the Purchaser within 14 days of receipt of the Product; in the case of separate delivery of multiple goods ordered by the Purchaser in a single order, the fourteen-day period for exercising the right of withdrawal shall commence on the day on which the last good is delivered.

The notice of withdrawal must specify the intention to withdraw from the purchase (it is not necessary to specify the reasons) and the Product or Products for which the right of withdrawal is to be exercised, attaching a copy of the documentation proving the purchase.
E.P. medica Srl will promptly send the Purchaser confirmation of receipt of the withdrawal via email to the email address provided during the purchase process on the Website.
In accordance with the provisions of Article 59, letters c) and d) of the Consumer Code, the Purchaser may not exercise the right of withdrawal for Products that are made to measure or clearly personalized or that are likely to deteriorate or alter rapidly.
Products for which the right of withdrawal is exercised must be returned within fourteen days from the day on which the Purchaser communicated the exercise of the right of withdrawal, substantially intact, in their original packaging, complete with accessories and any manuals, without any missing parts. Please note that if the Product was purchased in stores not belonging to the company, the Product must be returned directly to the same store.
The only costs payable by the Purchaser for exercising the right of withdrawal are the direct costs of returning the goods, as provided for in Article 57, paragraph 1, of the Consumer Code.
Once the withdrawal request has been received, E.P. medica Srl will refund the entire amount paid by the Consumer Customer within fourteen days from the date on which the Purchaser exercised the right of withdrawal, by crediting the bank account used at the time of purchase, or using the bank details provided by the Purchaser in the notice of withdrawal and, in any case, using the same payment method used by the Purchaser at the time of purchase. E.P. medica Srl reserves the right to withhold the refund until it has received the Products subject to the right of withdrawal, or until the Purchaser has demonstrated that they have returned the goods, whichever occurs first.
If, on the other hand, the methods, conditions, and terms for exercising the right of withdrawal, as specified in this article, are not complied with, the Purchaser will not be entitled to a refund of the sums already paid. In this case, the Purchaser may, at their own expense, recover the Product in the condition in which it was returned to E.P. medica Srl. Otherwise, E.P. medica Srl may retain the returned Products, in addition to all sums already paid by the Purchaser for the relative purchase. Shipping and transport costs shall be borne by the Purchaser.
Exclusion of the right of withdrawal
The right of withdrawal is excluded and, therefore, the preceding paragraphs do not apply to Contracts concluded with Professional Customers.
